If i own my car and owe childsupport can child support take that from me

i pay my support and i do owe arrears and they added that on as well, it is taken out of my check,so i am paying it , this is my car to get back and forth to work and to pick my kids up in ,i take good care of my kids

  1. If a judge gives the order they can, but it's a complicated process,,,,,,they're more likely to put you in jail.


  2. Generally, no. As long as it is just a regular car. Now, if you are behind, and like Dale Jr, have eight high dollar cars in your garage, they could go after some of them. But, the average joe who has one car they use daily, no.

    Generally, back child support is added to the monthly payments. They can't come after you for one lump sum. Best bet, don't get behind. Though I do not have to have my check garnished through the TX Atty, Gen, I do. It is always taken out, I don't have to worry about it, and there is a record it is paid every month.

  4. Not in any state I'm familiar with. Personal property is pretty much exempt from sale for arrerage.

  5. Not in most States. If you get too far behind, they can have your drivers license suspended. Since you are having the payments, including arrearages, taken from your check, you should be fine.

I live in Indiana & used to work in child support.  Yes, they can seize your vehicle & sell to pay your arrears.  They can also put liens on any property you may own.  As far as I know - other states can do this as well.  The best way to avoid this is, of course, to pay the money that is due to your child(ren).

Depends on how far behind you are.  They are allowed to place a lien on any property that is in your name (car, house, etc), once you get x amount behind.  And that x amount depends on what state you live in.  And what that does, is just keep you from selling it, without the profits going to your back child support.  So if you try to sell your car that has a child support lien, first your car loan gets paid & everything that is left goes straight to your child support debt.  Now, if you owe a ton & I mean a ton of back support, into the thousands.  Then they will actually sell your car out from under you & take the profits.  But selling something out from under someone takes a lot of paperwork, time & red tape.  That is why they won't do that unless you are WAY behind, & not making effort.  But since you are actually making extra payments to take care of your arrearage, you should be fine.  And they do have to notify you in advance as soon as they place the lien or try to take the car from you.
