  1. Delinquency is NOT a crime, therefore he is not charged with a criminal offense. hence; there is no trial.


  2. I'm not sure, I thought you were mistaken, but I just looked at the Pennsylvania juvenile justice rules and there is no provision for a trial by jury.  

    I believe the reason why Pennsylvania does not provide a jury trial option to juveniles is because there is no guarantee for a jury trial in delinquent matters in the US Constitution.

    The US Constitution, specifically the Sixth Amendment, only guarantees a Right to a trial by jury in Criminal Proceedings, since a juvenile is not charged with a crime but a delinquent act, it would seem that Pennsylvania deems it not necessary to have a jury trial for juveniles.  I believe that this could be successfully challenged in Court as a violation of your 6th amendment Rights.

    my guess is that you have to be an adult to be on a jury.  

    adults are not peers to minors

  4. 1971 McKeiver v. Pennsylvania established that trial by jury is a constitutional right that does not apply to minors. There are other cases relating to the rights of juveniles concerning jury trials.
