Question:

UK Employment Law: Cash-In-Hand Pay Dispute.?

A couple of weeks ago an old school friend asked if I would like to help him out by being a general labourer on a small job building a wall and extending his neighbours garden.

One friday towards the end of the job I was unable to make it to work. I informed him of this hours before I was due to start by text but got no reply. I had been paid for all work done up until this point apart from 2 days work. Over the weekend I called him to ask when I could collect the 2 days pay still owed but he informed me he would not pay it, claiming he had told me for every hour I miss he will deduct 2 hours pay, effectively meaning he is not prepaired to pay me for these 2 days of work done. The matter does not look like it will be resolved between us by talking alone, is there any legal recourse to this even though I have a feeling cash-in-hand is not allowed (i think) ?

  1. I DOUBT THAT THERE IS ANYONE YTHAT YOU COULD GO TO... IT NOT LIKE HE WILL HAVE A HEAD OFFICE OR A HUMAN RESOURCE DEPT... THINK THAT YOU NEED TO PUT THIS ONE DOWN TO EXPERIENCE.....BUT REMEMBER WHAT COMES AROUND GOES AROUND, AND HE WILL GET HIS CHICK..

  2. I'm assuming he didn't declare you for Tax and National insurance purposes which is illegal. I doubt you had a contract either. There seems little you can do, even if there was a course of legal action the costs would far out weigh what you would get. It's a sad way to end a friendship
