My employer has issued a new rule in our office, that states any employee that forgets to clock in for the day, will not be payed for the time they put in at the office. Is there some kind of labor law that this violates?

  1. You have to be paid for hours worked. It might be kind of difficult because you will have to prove you were there. But there has to be some sort of record that you were present or maybe even witnesses . I'm not sure try calling the U.S Department of Labor they should give you more info...It's worth a shot! good luck!

Live assistance is available Monday through Friday from 8:00 a.m. to 8:00 p.m. Eastern Time by calling, 1-866-4-USA-DOL, TTY: 1-877-889-5627.

Also I just posted your question to this employment law message  board I go to and this is the response.....

No. They're free to fire you or otherwise discipline you, but not refuse to pay you for time worked.

File a wage claim with the state department of labor folks, or the nearest federal Department of Labor wage-hour division office.
