Getting a divorce, child not my husbands!?

I have a child that's not my husbands. I know who the biological father is, i told him i was pregnant telling him it could be his, and when the baby was born i told him it wasn't his(not really knowing yet). so it has been 7months and hubby wants a divorce! wat do i do? how do i tell this guy that i lied and i really have his baby? wat is the legal thing to do? baby has hubby's last name what do i need to do to change it? wats the worse that can happen? I need help full advice! i know i made a stupid mistake but im living with my consequences! god knows i tried to make this marriage to work.help anyone!

 Excited and extremely happy, and thankful that my marriage with my husband has been restored. me and my husband have been married of 22 years together 23. After i found him texting a coworker and questioned him, he said they were just friends but 3 wks later he told me he didnt love me anymore that he was in love with her and that i made him feel bad about himself and she didnt. He left home for 2 wks came home and left 2 wks later. Been gone for 3 1/2 months now. Hes been going to bars, calling women, lying like crazy, drinking like a fish and hasnt spoken to the kids the whole time hes been gone. His whole personality has changed. We believe he is going thru some sort of mid life crisis. Its crazy, he is acting like a person that we dont know anymore. Is it possible to get my marriage back. Because I know that he is going thru some crazy thing right now Im finding it very hard to let go. I still love him. How can I save my marriage and family when my husband is in the middle of a mid life crisis and wont listen to my or anyone else. This is a mess and you are going to have to get legal help.

When you get an attorney involved they will go to the courts to get things going. But you will most likely have to pay for the paternity testing unless the supposed father is willing to pay. Chances are he won't and you will have to fork out the money. When the test shows he is the father you will get half of that money back for the test.

What are you wanting from the biological father? Child Support? You have to be able to answer the questions of the attorney such as the ones I just asked.

Just to let you know that once paternity is established and if he decides he wants on the birth certificate it has to be done.

If you choose child support he is given the right to have visitations with the baby. So you have to ask yourself if this is what you want.

The case against my youngest sons father took at year to resolve just because of him dragging his feet as was his attorney. Be prepared that this may be a long drawn out battle.

well you cant be too upset at yourself you said you didnt know so now that you do be happy its early on and the child isnt too old to resent you. if you and your husband cannot work this out then move on. inform the father asap he will have rights you can petition the court for a dna test and to have the babys name changed tell him you didnt lie about it not being his you just really wanted to believe it was your husbands. get a good lawyer too for the divorce and to keep your hubby from trying to get you to pay back anything he did for the child.

Did your husband sign the birth certificate and therefore acknowledge paternity?  If so, then the courts will recognize him as the legal father.

Well you go to court and file papers stating that there is a chance the child is not your husbands.  The court then orders DNA testing for all the parties involved.  Once a test proves who the father is, his name is put on the birth certificate and child support, visitation, etc (if wanted) is ordered.  Of course if baby is you hubby's that is part of the divorce proceedings.

your situation is more complicated because you're married and a child born into a marriage is considered the husbands...not to mention he is on the birth certificate.

you need to get an attorney and have a court ordered paternity test and your attorney will advise you on the route to take from there...

If Hubby is on the birth certificate, he will most likely remain the legal father.  That's what happens when a child is born within a marriage, even if the child is not the husband's.  That means your soon - to - be ex will have parental rights, and you can't change the last name without his permission.  Sorry, but it sounds like you have a long road ahead of you.  Remember this for next time.  Good luck.
