Expungment for arrest please help

My question involves criminal records for the state of : Michigan

Hi, exactly two years ago I was arrested for a reckless driving which is a misdemeanor,in the state of michigan, I went to jail for 25 mins then my causin bailed me out after they took my fingerprints , I went to court and my attorney was being able to reduce the charge from a Reckless driving which is a misdemeanor to a Careless driving which is a civil infraction the same if u dont wear u r seat belt . which it was good, after that I went on the website of the state of michigan to get my criminal record , it stated

NAme: My name

Date: Date of the Incident

then it says arrested for a traffic offense . PERIOD

I went back to my attorney and he expunged't for me , then few weeks ago I re ordered my criminal record and this

NAme: My name

Date: Date of the Incident

then it says arrested for a traffic offense . PERIOD

DIDN't APPEAr Nothing came up .

it said , Based on the information provided, the following is a certified result of the search as of 8/3/2008 11:08 PM

A search of Michigan's Criminal History File has not located a criminal record matching the information you provided. Since arrests, convictions or criminal record deletions may occur at any time, do not use this information for future clearances.

Meaning its really expunged and not their anymore

NOw here is the question : lets suppose tomo I get pulled over and the COP asks me " HAD YOU EVER BEEN ARRESTED " can I lawfully say NO ?

  1. Expungement by defintion means to erase as though it never occurred. The fact that you ran it a second time and it now says no match was found in the data base indicates the expungement order has gone through the system properly with the subsequent records being deleted.

    I will repectfully disagree with the above poster. You can legally state you were not arrested nor convicted now. The purpose of expungement is to give a first time offender a second opportunity at life again.

  2. Sounds like you got screwed by your attorney.

    If you tell an officer you've never been arrested, you'll be lying.

    You have been, period.
