Question:

Employment law question

My mom is working as carer with disabled people. It's a 24/7 job. Agency that gave her that job 3 years ago set her up as self-employed (she has to sort her own taxes etc.) and agency is charging the client 300GBP a my mom working there. If they charge agency fee, then my mom is clearly an agency worker and not self employed. After 3 years of work she must be entitled to paid holidays. She wrote a letter to agency asking for 1 week paid holidays and agency phoned her up and said that she has crossed the line. One day later my mom received a letter form agency stating that they will pay for 1 week holiday, but after the holiday she does not have a job anymore.

I think she should go take the agency to tribunal, because agency is clearly violating employment law by collecting agency fee monthly but telling staff they are self employed and then for threatening with dismissal just because my mom stood up for her rights.

If you have any advice I would really appreciate it.

Thank you

  1. government based ripoff, as usual. corrupt politicians encourage crooks to ripoff the little people. creative capitalism gone amuck. tar and feather the politicians and never be surprised when they announce another "catch 22" to "got'cha."

bad government by the ruling elite. little people do not count, just treated like sheeple to be herded and routinely fleeced.
