"I didn't break her car windows, but I was in her apartment complex area"

If it doesn't qualify as probable cause can someone explain what it means?

  1. No. It is not just because you where in the area doesnt mean you didi it. There has to be proof that you didi it. Some kind of witness that saw you comit the act or some sort


  2. Depending on the situation. Someone could have seen you in the apartment complex near her car. The time of day or night, the location of your residence compared to hers. These are all factors in developing probable cause for the arresting officer. If you didnt live in the area where she lives, why were you in the area. All of these are questions that develop probable cause.

  3. The definition of probable cause is any information that would lead a reasonable person to believe the suspect committed a crime.

    Being in the area may help, but alone will not establish probable cause. The next question should be directed at why he was in the area, and if the explanation is reasonable.
